DMCA limitations include network transmission, routing, and connections to, as well as transient copies made automatically in the operation of a network of, copyrighted material.  The University of Iowa when obtaining knowledge of activity that infringes on the rights of a copyright owner, acts expeditiously to remove or disable access to the material.

 

Procedure exempting The University of Iowa from liability for copyright infringement:

Upon receipt of proper notice of infringement from a copyright owner/agent, the UI’s DMCA Agent (or designate) promptly removes or disables access to the copyrighted material in question, and notifies the alleged infringer. Notification from the copyright owner must include:

  1. Physical or electronic signature of the owner or their agent
  2. Identification of the work infringed
  3. Identification of the material infringing
  4. Information sufficient for UI to contact complaining party (name, address, phone, email)
  5. Statements of good faith and accuracy of the complaint

If a proper counter-notice is filed by the alleged infringer, the UI’s DMCA Agent (or designate) will restore the material or access to the material within 14 business days, and provide notice to the copyright owner within 10 business days.  Notification from the alleged infringer (subscriber) must include:

  1. Physical or electronic signature of the subscriber
  2. Identification and location of the material that was removed
  3. Statement of good faith that material was removed/disabled by mistake
  4. Subscriber name, address, phone, and statement accepting service of process from the owner/agent of the material in question
